In October 13, 2006, the Ministry of Commerce of People's Republic of China issued the Announcement No. seventy-fourth in 2006, and decided to impose anti-dumping duties on imported spandex originating in Japan, Singapore, Korea, Taiwan and the United States.

Among them, the anti dumping duty rate of OPELONTEX Co. (Ltd.) is 12.87%. OPELONTEX


In December 3, 2009, Toray Opelontex Co. (Ltd.) of Japan submitted an application to the Ministry of Commerce, requesting the inheritance of the anti-dumping duty rate applied by Japan's OPELONTEX company in the anti dumping measures of spandex, and submitted relevant certifications of the board of directors and shareholders' meeting, registration of alteration, operation and management, production equipment, supply relations, customer base and relevant notarization and the certification document of my Embassy in Japan (consulate) in Toray, Opelontex.


In December 15, 2009, the Ministry of Commerce informed the mainland China spandex industry on the above application.

Within the stipulated time, the spandex industry in mainland China did not raise any objection.


After examination, the existing evidence material indicates that the name change of Japanese Toray Opelontex is in conformity with the relevant laws and regulations of Japan. The management, production equipment, supplier relationship, customer base and management personnel of spandex have not changed before and after the company name changes.


Accordingly, the Ministry of Commerce decides:


1. Japan's Toray Opelontex company inherits 12.87% anti-dumping duty rate and other rights and obligations applicable to Japan's OPELONTEX company in the antidumping measures of spandex.


Two, the spandex products exported to mainland China with the name of Japanese OPELONTEX company shall be applied to 61% anti-dumping duty rates applicable to other Japanese companies in the anti dumping measures of spandex.


This notice will be implemented from February 5, 2010.
